The DC Circuit Court of Appeals issued an administrative stay and explained “The purpose of this administrative stay is to give the court sufficient opportunity to consider the emergency motion for stay pending appeal and should not be construed in any way as a ruling on the merits of that motion.” Meanwhile, at almost the same time as the Court of Appeals issued its order, Judge Jackson largely denied the motion for a stay, though of course the Court of Appeals’ decision governs over Judge Jackson’s. Judge Jackson’s five-page order is scathing, saying that “[a]pparently, the defendants have not read the entire Memorandum Opinion,” and accuses the government of “blatant mischaracterization of the [District Court’s] Order.”
