Maryland enacts anti-surveillance pricing bill

Text available here. It’s believed to be the first law banning surveillance pricing in the country (New York has a law requiring that any use of algorithmic pricing be disclosed). The law is limited to larger grocery stores and delivery services. It follows a December story by Consumer Reports that Instacart was using surveillance pricing to charge different customers as much as 23% more than other customers for the same products, a practice Instacart abandoned after the story appeared. It will be interesting to see, first, if other states enact similar laws, second, if surveillance pricing bans are enacted to other businesses, and third, what impact the law has.
