The Federal Trade Commission today issued a final rule on junk fees. Under the rule, businesses that offer live-event tickets or short-term lodging must clearly and conspicuously disclose the total price at the time they offer, display, or advertise their tickets or stays. This removes the possibility of surprise fees and charges that ticket buyers and hotel guests often come across during transactions. A violation of the requirement constitutes an unfair and deceptive practice. The rule also requires other clear and conspicuous disclosures before a consumer consents to pay. In addition, the rule states that it is unfair and deceptive for businesses offering live-event ticketing or short-term lodging to misrepresent fees or charges in their offers or advertisements.
